Apache Brave Terms and Conditions


Thank you for choosing Apache Brave, the best place to book mobile professional services in your home, out doors, hotel or office.

These terms and conditions of service together with any terms and policies referred to in them (" Our Terms ") constitute a legally binding agreement between you and Apache Brave (" Apache Brave ", “we ", “us” or “our "). Apache Brave is a private sole trader company registered under Richard Watson, Apache Brave and Apache Brave Racing are trading names only.

Please read Our Terms carefully and thoroughly. If you do not accept Our Terms, you must not make a booking through Apache Brave for any Service or Services.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 requires Apache Brave to give you certain key information for there to be a legally binding contract between you and us. This information is set out below. Details on how to make a booking are set out on our booking page. If we wish to change any key information once a legally binding contract is made, we can only do this if you agree to it.

Full payment of Services Fee is due at the time of services. Full details of the prices are referred to on our booking page.

PRICES

The price of Services (each a "Services Price" and collectively "Services Prices") varies according to the type and duration of the Services you book and also the location of the premises you have designated for the Services to be provided to you by the Therapist (" Designated Premises "). Services Prices are set from time to time and the Services Price you will be required to pay for a specific Services (each a "Services Fee" and collectively "Services Fees") will be determined by reference to the Services Prices in force at the date when that Services is booked.

CUSTOMER RESPONSIBILITIES


In addition to the responsibilities noted above, it is your responsibility to provide complete and accurate information at the time of booking. Failure to provide complete and accurate information may result in a rejection of your booking request, cancellation of your booking or an inability of the booked Therapist to provide the Services as requested. Such failure may also result in loss or incorrect delivery of your booking confirmation.

1. Definitions

1.1 ‘Apache Brave' & 'Therapist' or 'Trainer' & ' Coach' means Richard Watson

1.2 ‘Client’ means the person and/or company for whom the Services have been requested

1.3 ‘Booking Form’ means the form containing the booking details that has been emailed to, text to and confirmed by the Client in advance of the booking

1.4 ‘Service’ means the Service/s requested by the Client.

1.5 ‘Agreed Minutes’ means that a Practitioner/s will be available for the minutes as requested by the Client.

1.6 ‘Practitioner’ means who attends the Premises for the purpose of performing the Service

1.7 ‘Individual’ means the individual client who has requested the Service

1.8 ‘Premises’ means the location address as provided by the Client

1.9 'Duration of session' the duration starts once Apache Brave has arrived at the desired premises, the length of duration is at the discretion of Apache Brave and may run under or over the required purchased time. Apache Brave has the right to determine the length of session and has the right to cut short a service. Payment charges is at the discretion of Apache Brave and is charged accordingly.

1.9.1 A session length is measured from arrival to departure times and not actual service time.

2. The Provision

2.1. Apache Brave shall provide qualified and insured Practitioner to the Client at the Premises for the Agreed Time.  Practitioners are covered for Professional Indemnity and Public Liability insurance with the limit of liability. Copies of the Practitioners certificates will be sent to the Client on request.

2.2. The Practitioner reserves the right not to provide the Service for any Individual they deem unfit to receive such Service. It is general Apache Brave policy that our services will NOT be provided for Individuals in the first trimester of pregnancy.

2.3 Privacy; Client services details will not be discussed with anyone other than the client unless the client is under the age of 18 or has a care worker or guardian

2.4 Consultation Forms and services notes will be kept on file, securely by Apache Brave

2.5 All clients must complete a consultation form prior to receiving Apache Brave services By signing the consultation form, clients are giving Apache Brave permission to hold records and data about them Personal information will not be shared with any third parties. A verbal consultation maybe done prior to service, this is deemed adequate enough to provide service for the required treatment/service. All clients accept all responsibility for any harm, or injury. This is classed as a verbal contract.

2.6 Aftercare Advice. You may feel light headed, tired, and dehydrated after your services. It is important that you drink plenty of water directly after the services and for the rest of the day to flush metabolic waste from the tissues that have been treated. Try to relax for the rest of the day/evening following services. No heavy exercise should be undertaken for a least 24hrs. Ice pack applications or warm baths maybe recommended following services depending on your individual complaint.

2.7 Contra-indications. Services are not recommended for certain people, for example: People with infectious skin diseases, rashes, or open wounds. Immediately after surgery. Immediately after chemotherapy or radiation, unless recommended by your doctor. People with osteoporosis should consult their doctor before getting a service. People prone to blood clots, there could be a risk of blood clots being dislodged. Services should not be done directly over bruises, inflamed skin, unhealed wounds, tumors, abdominal hernia, or areas of recent fractures.

3. The Client’s Obligations

3.1. The Client must provide a suitable area for the Service to take place and a contact person for Apache Brave to liaise with.

3.2. All Individuals receiving therapy services must sign a medical consent form prior to services; any subsequent services a verbal consent is required. For events and corporate events a verbal consent is deemed acceptable.

3.3. The Client is responsible for delivering a schedule to the Practitioner before the start of the Agreed hours if applicable.

3.4. The Client will explain to each Individual condition and the nature of any injuries prior to services.

3.5 Young clients under the age of 18 must be accompanied by an adult. The adult must give permission for the services to be performed. The adult must co-sign the client’s consultation form. The adult must be present in the room throughout the services

3.6. Clients confirm that the information stated on any consent form or verbal consent is accurate to the best of their ability. They further fully understand that thorough and honest responses to these questions are essential to their safety. They undertake to inform the therapist of any changes to the information they have provided. The client understands that an assessment needs to take place in order to establish a treatment or training plan.  All assessment, training and treatment procedures have been thoroughly explained and they (the client) are happy to proceed and take all responsibility for their own wellbeing and safety and exempt the therapist of any harm, injury, death loss that any services may cause.

3.7 If a client has not provided a consent form or informed Apache Brave of any health related condition it is deemed the clients reason-ability to inform Apache Brave before taking on any service or advice given by Apache Brave. The client is wholly responsible for their action. Apache Brave takes no reasonability for actions of a client.

4. Payment by the Client, Additional  Charges & Booking

4.1. The agreed fee for the Services is as shown on the Booking Form. If a price is not shown for a client’s requirement a price will be agreed between Apache Brave and the client before services takes place, this then becomes a legal binding contract between the two parties. If no price has been agreed then the  client accepts the current listed price on Apache Brave Web site.

4.2. Payments can be made by BACS and are due 10 days prior to the booking date or immediately if the booking date is less than 10 days away. The Client will be issued with an invoice which will contain instructions on how to make payment. If payment is not received by the due date, the booking may be cancelled. Bookings are not confirmed until payment is made. Apache Brave accepts card payment via the use of card machine through "Sum Up". Payments can also be made with cash on the day of service and must be paid on completion of service.

4.3. Any changes to the Agreed Hours or Services requested once payment has been made and the booking confirmation has been received may affect the agreed fee. Additional fees will be invoiced and payment requested on receipt of invoice. Any refunds due will be credited back to your original method of payment within 30 days subject to a £10 administration fee.

4.3.1 Out of normal office hours charges. Additional charge may be incurred by the client if they require services out of normal office hours. Normal office hours are publish on Apache Brave Website or can be requested via the therapist. These charges are at the discretion of Apache Brave and may be added to the service price. 

4.3.2 Out of area/traveling time charges. Apache Brave provide a mobile service within a certain distance or time allowance (generally 20 minutes) or that have a CV post code (subject to distance and traveling time) from Apache Brave's registered office. If the clients requested address is out of this area or traveling time then additional charges will be incurred to the client. These extra charges will be notified to the client prior to booking. These charges are at the discretion of Apache Brave.

4.3.3 All extra costs are notified to the client at time of booking, if the client confirms booking that agrees them to any additional costs incurred. A client may also request extra services during treatment, these extras will incur costs and will be agreed between the client and therapist at the time.

4.4. For block booking purchases discount will only be applied to the last services price, if a block purchase is cancelled and the client requires a refund all services that have been received will be charged at full services price at current rate.

4.4.1 Block booking purchases must be made in full prior to any services taking place.

4.4.2 Block booking packages must be used with one year of purchase to stay valid, any unused service after this date will become invalid, a discretion can be made by Apache Brave.

4.5. For bookings where the Individual pays or part pays

4.5.1. Individuals should pay their proportion of the fee directly to the therapist.

4.5.2. Any outstanding amount will be invoiced to the Client for immediate payment.

4.6 Apache Brave  reserves the right to charge interest on all payments made after the due date at a rate not exceeding seven percent per annum above the base rate of HSBC Bank plc from time to time, interest to be calculated on a daily basis until satisfaction of any Judgment Debt or payment in full (whichever is later).

4.7 Payment to Apache Brave must be paid on the day of the service

4.8 Certain services require payment prior to commencement; this payment balance must be cleared and paid before any service starts. This payment will be confirm with the client and Apache Brave.

5. Cancellations and changes

5.1. A booking is confirmed once Apache Brave and the client have both agreed a date, time, duration and location for a service. Once a booking form has been submitted, cancellations will incur the following charges: Cancellations made with less than 24 working hours’ notice will be charged at the full rate

5.2. Changes to the Agreed Hours may be made by giving 5 days written notice. Changes to the Agreed Hours with less than 5 days notice are at the discretion of Apache Brave.

5.3. Apache Brave reserves the right to cancel the provision of the Service without notice in case of the illness of a Practitioner or other circumstances beyond its control. Apache Brave shall make reasonable attempts not to cancel the Service but the Client acknowledges that it may not be possible for a Practitioner to attend the Premises. In this circumstance the Client will be offered an alternative day.

5.4. Any refunds due will be repaid back to the client via original payment method within 100 days of the cancellation date.


5.4.2 Refunds on packages deals are as follows: only your last sessions of the package deal is discounted, this means if you cancel and request a refund then all sessions used are charged at full amount as per a "1 session" price. If your sessions have been used all except the last session and you request a refund on that session then it will be the sum of full priced session x No and remaining amount is then paid.

5.5 This cancellation fee may be waived at Apache Brave discretion.

5.6 Apache Brave has the right to cancel a service without notice

5.7 Apache Brave has the right to cancel a service without notice if the room or environment is unsuitable for the services to be provided, or if the therapist is taken ill

5.8 Apache Brave has the right to cancel a service without notice if the client is intoxicated or inebriated

5.9 Apache Brave commits to rearranging services to a new time and date within two weeks of the cancelled services where possible

5.10.1 Apache Brave has the right to terminate a service immediately if the client demonstrates inappropriate or sexual behavior

5.10.2 Payment will be collected for the full services price, provided more than 10 minutes has been spent treating the client

5.10.3 If the therapist is unable to collect money before leaving, an invoice will be sent to the client’s address. All invoices must be paid within 7 days of issue date

6. Vouchers

6.1 Vouchers can be used as payment towards any available, advertised services

6.2 Vouchers are only valid for one use

6.3 Vouchers are only valid up to and including the expiry date

6.4 Refunds are not available for vouchers already paid for and provided

7. Termination

7.1. This Agreement will terminate automatically if

7.1.1. Either party shall be in breach of any of its obligations under this Agreement;

7.1.2. Either party shall have a receiver, administrative receiver, or administrator appointed, or shall enter compulsory or voluntary liquidation.

8. Liability & Insurance

8.1. The Client acknowledges that any liability as to the provision of a Service is between an Individual and the Practitioner.

9. Law & Complaints

9.1 This Agreement shall be subject to English Law and the sole jurisdiction of the English Courts

9.2 If a client wishes to make a complaint about Apache Brave, this must be emailed to the address specified on our booking page Complaints must include the date and location of the incident, the full name of the complainant, details of the complaint and a desired outcome following the complaint All complaints will be taken very seriously and a response will be provided within 28 days
